On Wednesday, November 20, 2024, the weekly meeting of Grupo Madrugadores took place at the Mezquite restaurant, located inside the Vidanta Hotel in San José del Cabo. In the autumn breeze and with a delicious breakfast, the group was ready to listen to the phrase of the German jurist Rudolf von Ihering (1818-1892), a professor considered the father of legal sociology, which started the assembly: “The law that does not fight against injustice denies itself”.
After the moderator was appointed, Gabriel Corral introduced the special guest, Magistrate Bárbaro Valenzuela Serrano, who analyzed the issue of judicial reform and its implementation in Baja California Sur and the country.
“It is a pleasure to have been invited to the Madrugadores Group. We talked about the modifications to our legislation and the harmonization that we will have to do in this sense so that the primary laws, in this case, the local Constitution of the state of Baja California Sur, are harmonized in terms of the rules and forms of selection, first of all, of the candidates for the post of magistrates and judges of the locality, as well as their election in the terms established by the local procedural norms, which will be defined by the State Executive in conjunction with the local Legislature for an election, either in an extraordinary election in 2025 or in a constitution in 2027, to which every one of us who are officials of the Judiciary and who are judges and magistrates within the State Judiciary itself should go”.
As usual, the attendees actively participated with questions, comments, or proposals, promoting an open and enriching dialogue that concluded in the commitment to the postulated actions.
